The petitioner seeks bail in Hajipur Industrial Area P.S. Case No.04 of 2020, registered for the offences punishable under Sections 302, 328 and 34 of the Indian Penal Code. Allegation against the petitioner is of killing the brother of the informant by poisoning him.

Learned counsel for the petitioner submits that petitioner is named in the FIR, but there is no specific overt act alleged against him. The allegation against the petitioner and other co-accused persons is that they were seen with the deceased. The petitioner is in custody since 26.07.2020 and he has got no criminal antecedent as stated in paragraph 3 of the bail petition.

Patna High Court CR. MISC. No.3926 of 2021(4) dt.02-11-2021 2/2 Learned Additional Public Prosecutor for the State opposed the prayer for bail of the petitioner. Having considered the facts aforesaid, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Industrial Area P.S. Case No.04 of 2020.
