1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2022.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is in custody since 06.06.2026 and allegation is of recovery of 19.8 litres of codeine cough syrup from grocery shop of Bihari Kumar. It is next submitted that petitioner was not arrested from the spot as such nothing was recovered from his conscious possession and he came to be implicated based on confessional statement of Bihari Kumar in police custody which does not have any

4. Learned A.P.P. opposes the prayer for bail of the petitioner and submits that of late codeine cough syrup has become menace in the State of Bihar as young boys of impressionable age are using codeine for intoxication.

5. At this stage, learned counsel for the petitioner seeks permission to withdraw the regular bail application with liberty to renew his prayer for bail after framing of charge.

6. Permission is accorded.
