JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-12-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366(A), 363, 420, 120B of the Indian Penal Code.

The accusation is kidnapping the minor daughter of the informant. In 164 Cr.P.C statement the victim has supported the accusation against the petitioner also. It is submitted by learned counsel for the petitioner that for the occurrence of 22.07.2015 the First Information Report was registered on 01.09.2015. The 164 Cr.P.C statement of the victim was recorded after 29 days of the alleged occurrence.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Let learned Court below consider the prayer for regular bail of the petitioner, keeping in view of the delayed

Patna High Court Cr.Misc. No.54588 of 2015 (2) dt.02-12-2015 2/2 lodging of the case, if the petitioner surrenders within a period of six weeks in connection with Bela P.S. Case No. 132 of 2015, pending in the Court of learned Judicial Magistrate, 1st Class, Sitamarhi.

With the observations above, the application stands disposed off.
