The petitioner seeks bail in a case registered for offences under Sections 143, 144, 145, 158, 290, 414, 272 and 273 of the Indian Penal Code, Sections 25(1-B)A, 251AA, 25-1AAA, 26, 26(ii), 35 and 27 of the Arms Act and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016. It is contended that, as per allegation, petitioner was arrested in inebriated condition along with 21 accused persons and from the possession of some of the accused persons arms and live cartridges were recovered but nothing

Patna High Court Cr.Misc. No.51098 of 2017(2) dt.09-11-2017 2/2 was recovered from the possession of the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 23.08.2017.

Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Muzaffarpur in connection with Muzaffarpur P.S. Case No. 421 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
