The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 341, 323, 307, 379, 504, 506, 34 of the Indian Penal Code. Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.3462 of 2021(2) dt.22-11-2021 2/3 petitioner no.6 has been arrested and as such, he seeks permission to withdraw this application against the petitioner no.6.
Accordingly, this application is dismissed as withdrawn against petitioner no.6.
It has been submitted by learned counsel for the petitioners that the petitioners are innocent and have falsely been implicated in this case. There is case and counter case between the parties. Altogether three persons sustained their head injuries and other parts of body caused by hard blunt substance. Both parties have got injuries and the injuries are simple in nature. They have got no criminal incident. Learned APP for the State vehemently opposed the prayer for bail of the petitioners.
In the aforesaid facts and circumstances of the case, let the petitioners except petitioner no.6, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Mohania P.S. Case No. 79/2020, subject to the
Patna High Court CR. MISC. No.3462 of 2021(2) dt.22-11-2021 3/3 conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
