Learned counsel for the petitioner submits that during pendency of this application, the order of punishment passed by the Engineer-in-Chief has since been affirmed by the appellate authority and, as such, he may be given permission to withdraw this application in order to enable him to assail both the orders by filing a fresh writ application.

This application is, accordingly, permitted to be withdrawn with the aforesaid liberty.
