The petitioner seeks bail in Sasaram (Model) P.S. Case No. 1213/2016, instituted under Sections 341, 323, 324, 326, 307/34 of the Indian Penal Code read with Section 27 of Arms Act.

Learned counsel for the petitioner has submitted that petitioner has clean antecedent. He is not named in the written report. Name of this petitioner has been disclosed by the injured before the police in his statement recorded under Section 161 Cr.P.C., after ten days of occurrence. Statement of victim has been recorded in para 26 of case diary, wherein he has claimed to identify the accused by cloth, gesture and voice. Besides such material, there is nothing against this petitioner.

Patna High Court Cr.Misc. No.64649 of 2018(3) dt.22-11-2018 2/2 Petitioner is in custody since 10.08.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sasaram in connection with Sasaram (Model) P.S. Case No. 1213/2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
