JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Complaint Case No. 1625 of 2015 registered for the offences punishable under Sections 420 and 354 of the Indian Penal Code. The complaint petition goes to show that the complainant went along with petitioner to Gurgaon and started living with the petitioner as a husband and wife. Subsequently, petitioner refused to marry with her.
Submission on behalf of the petitioner is that no such occurrence as alleged in the complaint petition did ever take place and, as a matter of fact, the complainant has brought this false case
Patna High Court Cr.Misc. No.45100 of 2016 (2) dt.20-12-2016 2/2 against the petitioner with an intent to put pressure upon him for marriage.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Banka in Complaint Case no. 1625 of 2015, subject to condition as laid down under Section 438(2) of the Cr.P.C.
