JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 17-09-2016 The writ application has been filed and duly served on the State counsel way back on 4.12.2015. The primary relief which the petitioner is seeking is to release a sum of Rs.1,77,860/- to which he is entitled to and which is also borne out from the letter no.460 dated 11.7.2015, written by the Circle Officer, Barahat to the Additional Collector, Banka. The only reason why the payment has not been made is that no allotment has been made for release of the payment.

More than a year has passed since that letter had been written. More than nine months have passed since the writ

Patna High Court CWJC No.18707 of 2015 dt.17-09-2016 2/2 application had been filed. If the Government is really concerned about the poor people as they claim, these are matters which should not travel to the High Court. Such matters should have been redressed and addressed at the local level on due priority, especially when the Court is informed that the petitioner, who is a retired employee, is also suffering from Cancer and he is in distress. If payment to the petitioner is not released by the Collector, Banka within four weeks, he will stop drawing salary till further orders of the Court. Writ application stands disposed of with the above direction.
