The petitioners apprehend their arrest in a case registered for offences punishable under Sections 304B/34 of the Indian Penal Code.

It is contended on behalf of the petitioners that the husband of the deceased was already granted anticipatory bail vide Annexure 2 by a Co-ordinate Bench of this Court considering that the case diary suggests that deceased had committed suicide and husband was not in the village on the date of occurrence. Subsequently, police filed final form exonerating the petitioners

Patna High Court Cr.Misc. No.37919 of 2016 (2) dt.22-09-2016 2/2 but cognizance has been taken under Section 304B/34 of the Indian Penal Code. Petitioner no. 1 is mother-in-law and petitioner nos. 2 and 3 are brother-in-law and sister-in-law respectively of the deceased.

Having regard to the facts and circumstances, and the fact that the husband of the deceased has already been granted anticipatory bail, let the above named petitioners be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Motipur P.S. Case No. 148 of 2013, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Muzaffarpur (West) subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
