JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-07-2019 This is an application for grant of anticipatory bail in connection with Kishanganj P.S. Case No. 354 of 2018, disclosing offences under Sections 406, 420, 384 and 120B of IPC.

Prosecution story is that when the wife of the informant was hospitalized for thyroid operation and one unit of blood was required for that, on which, an unknown approached him and agreed to provide one unit blood of Rs.4000/-. However, he received the receipt of Rs.500/- only. The petitioner is not named in the F.I.R. However, his name transpired in the confessional statement of the co-accused. Submission of the learned counsel for the petitioner is that except confessional statement, there is nothing against him and he is ready to abide by any condition imposed upon him. Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Kishanganj, in connection with Kishanganj P.S. Case No. 354 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
