In this case, the petitioners are seeking anticipatory bail in connection with Tarari P.S. Case No. 32 of 2019 registered for offence punishable under sections 147, 148, 341, 342, 307, 353, 338, 504, 506, 149, 224, 225, 511, 332, 333, 337 of the Indian Penal Code and section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Allegation has been made that an information was received, Raju Kumar and Umashankar Ram are involved in the business of liquor, on that information,police raided the house of Raju Kumar and Umashankar Ram and recovered 13 bottles of Crazy Romeo Whisky from the possession of Raju Kumar and 30

Patna High Court CR. MISC. No.43268 of 2019(2) dt.12-07-2019 2/2 L. Mahuwa wine 162 pouch of 200 ML. from the possession of Umashankar Ram and they were arrested. Petitioners are wife, daughter and father of Umashankar Ram and save and except relationship, there is no incriminating material against these petitioners and no allegation has been attributed against them. Looking to the entire facts and circumstance of the case, the prayer for bail of the petitioners is allowed and they, in the event of arrest or surrender before the court below within six weeks from today, are directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Bhojpur at Ara in connection with Tarari P.S. Case No.

32 of 2019, subject to the conditions as laid down under section 438 Cr. PC and also subject to the condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. The petitioners will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make themselves available as and when required by the court.
