JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-09-2016 The petitioners being parents of the husband of the informant are apprehending their arrest in a case registered for the offences punishable under Sections 323, 504, 506, 498A, 34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
The basic accusation is of torture for nonfulfilment of dowry demand. It is submitted by learned counsel for the petitioners that accusation is omnibus and general against the entire in-laws family including the petitioners and the thrust of accusation is against the husband of the informant. The impugned order reflects that the issue could not be reconciled due to the adamant attitude of the husband of the informant.

No.40819 of 2016 (2) dt.20-09-2016 2/2 Considering the fact that thrust of accusation is against the husband of the informant, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 90 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
