JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-11-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with N.D. P.S. Case No. 15 of 2017 arising out of Udwantnagar P.S. Case No. 139 of 2017 for the offences punishable under Sections 20/22 of the N.D.P.S. Act.
The case of the prosecution is that on secrete information the police had raided the premises of one Guddu Singh and recovered Ganja from two polythene packets under the bed in his room. Thereafter, a raid was conducted in the nearby house from where one person i.e. the petitioner herein, after seeing police force, tried to flee away and upon search some ganja was recovered from a vehicle standing in the house of the petitioner. No.53157 of 2017 (2) dt.09-11-2017 2/2 made from his vehicle since, admittedly, the vehicle belongs to one Sanju Devi who is wife of his cousin and there is a family partition between his cousin and the petitioner. It is further submitted that there is no recovery from possession of the petitioner.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner, above named, on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned 2nd Additional District and Sessions Judge, Bhojpur at Ara in connection with N.D.P.S. Case No. 15 of 2017 arising out of Udwantnagar P.S. Case No. 139 of 2017.
It is directed that the petitioner shall appear before the learned trial court on each and every date and on his failure to appear before the learned trial court on two consecutive dates, the privilege of regular bail granted to the petitioner would stand withdrawn, the bail bond of the petitioner would be cancelled and he would be taken into custody forthwith.
