Petitioners seek bail in a case registered for the offences punishable under Sections 341,323,324,308/34 of the Indian Penal Code.
Patna High Court Cr.Misc. No.60499 of 2017 (5) dt.12-02-2018 Supplementary affidavit has been filed by the petitioners disclosing the result of their past criminal cases. There is no eye witness of commission of assault by the petitioner-Pankaj Singh.
Submission is that case dairy would reveal that the specific allegation of commission of injury at the head of the informant is co-accused Arjun Singh and in the FIR, there is vague allegation against Rajesh Singh and coaccused Arjun Singh to have caused injury. Doctor has found single head injury.
Learned counsel for the informant opposed the prayer for bail.
Considering the aforesaid fact, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Barachatti Police Station Case No.466 of 2017, subject to the condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
