JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 05-04-2021 Learned counsel for the petitioner undertakes to remove all the defects as pointed out by office within four weeks after start of normal functioning of the Court. Heard learned counsel for the petitioner and learned A.P.P. for the State.
Petitioner in the present case is seeking regular bail in connection with Chainpur P.S. Case No. 444 of 2019 registered for the offences punishable under Sections 304-B/201/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that as per the prosecution story marriage between daughter of the informant and petitioner had taken place on 19.05.2019. It is alleged that after the marriage the daughter of the informant was being tortured and assaulted for not bringing sufficient dowry.
Patna High Court CR. MISC. No.243 of 2021(10) dt.05-04-2021 2/3 The allegation is also that the daughter of the informant was informing that she was being assaulted and beaten for not bringing dowry. It is further alleged that on 26.12.2019 at about 5.00 A.M. father of the petitioner gave a telephonic message to the informant that his daughter has died thereupon the informant visited the place of the petitioner but the dead body of the daughter of the informant was not found.
Learned counsel for the petitioner submits that the wife of this petitioner was suffering from Appendicectomy and she was taken to the doctor. In this connection a report from diagnostic center has been placed on the record. However, in course of investigation it has come that the daughter of the informant was taken away by the relatives from the Sadar hospital without saying anything to the doctor. Learned A.P.P. for the State has opposed the prayer for regular bail of the petitioner. It is submitted that the death of the newly wedded wife of the petitioner has taken place within three months of the marriage that too within the premises of the matrimonial home and the dead body of the victim was concealed by the petitioner and his family.

No.243 of 2021(10) dt.05-04-2021 3/3 months of the marriage in the premises of the matrimonial home and the petitioner happens to be the husband of deceased against whom there are allegations of demand of dowry and torture, this Court is not inclined to grant bail to the petitioner, prayer is refused. Let the trial be expedited.
