In this case, the petitioner is seeking regular bail in connection with S. Tr. No. 84 of 2017, arising out of Barachatti P.S. Case No. 458 of 2014, registered for the offence under Sections 279 and 304(A) of Indian Penal Code. Later on, Sections 328, 302, 201, 379 and 120(B) / 34 of the Indian Penal Code was also added.
Today, learned A.P.P. has produced the photocopies of reports of the Senior Superintendent of Police, Gaya, as well as conducting A.P.P., from where it appears that all the witnesses have been examined.
Patna High Court CR. MISC. No.61879 of 2018(8) dt.16-09-2019 2/2 In such view of the matter, this Court is not inclined to grant bail to the petitioner for the present. However, this Court directs the Court below to conclude the trial within a period of three months from the date of receipt of a copy of this order.
Let a copy of this order be communicated to the concerned Presiding Officer for his information so that the trial would be concluded within the prescribed time fixed by this Court.
The photocopies of the aforesaid reports of the Senior Superintendent of Police, Gaya, as well as conducting A.P.P., be kept on record.
