JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
The prosecution case is that six accused persons including the petitioner assaulted the husband of the informant and dragged him when co accused Subhash Singh pierced barchhi in the lower side of abdomen of the informant's husband. It is submitted by the learned counsel for the petitioner that the postmortem report reflects two piercing injuries and one abrasion. The accusation of dragging the informant's husband is omnibus and general and no dragging injury was found. Statement
Patna High Court Cr.Misc. No.54296 of 2015 (2) dt.01-12-2015 2/2 has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. More over, the informant side subsequently killed accused Subhash Singh.
Considering the fact that no specific accusation has been levelled against the petitioner, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Hilsa, Nalanda, in connection with Karai Parsurai P.S. Case No.102 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
