This is an application for bail in connection with Sheikhpura P.S. Case No. 16 of 2017, registered for the offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner and two other persons is of forcibly taking the deceased out of his house causing his death.

Submission of learned counsel for the petitioner is that there is no allegation of firing against this petitioner and one of the co-accused namely Darmendra Paswan having similar allegation has been granted bail vide order dated 04.05.2017 by a coordinate Bench of this Court passed in Criminal Miscellaneous No. 17028

Patna High Court Cr.Misc. No.56177 of 2017 (2) dt.20-11-2017 2/3 of 2017. He is in custody since 06.09.2017. It has also been submitted that the petitioner has to appear at the examination of B.A. Part-II (Hons.), which is likely to be held on 22.11.2017. Heard learned APP also.

Having heard both sides and in view of facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sheikhpura in connection with Sheikhpura P.S. Case No. 16 of 2017, subject to the conditions as follows:

(1) One of the bailors shall be a local person having sufficient immovable properties within the jurisdiction of the court concerned.

(2) Petitioner will mark his attendance in local station in first week of every month at least for one year so that police may watch his conduct during the said period, failing which his bail bond shall be cancelled.

(3) The petitioner shall cooperate in the
