The petitioner apprehends his arrest in Bairgania P.S. Case No. 191/2015, registered for the offences punishable under Sections 328, 304B and 34 of the Indian Penal Code. The petitioner is the husband of the deceased. The informant alleged that his sister Tetri Devi was married with Rijhan Shah in the year 2011 but her husband and other in-laws subjected her to different sorts of cruelty. On 10.10.2015, Sunita Devi called the informant and disclosed that Tetri Devi died at 5.00 PM on account of assault made by her husband and others. Learned counsel for the petitioner submits that there is no external or internal injury on the body of the deceased. The case has been compromised. Viscera report was kept reserved and
Patna High Court Cr.Misc. No.42907 of 2016 (3) dt.22-11-2016 2/2 the same was sent to the Forensic Science Laboratory for examination.
It appears that the informant made very specific allegation that after marriage the petitioner and other in-laws subjected his sister to different sorts of cruelty and killed his sister. Considering the facts aforesaid, I am not inclined to enlarge the petitioner Rijhan Sah above named on anticipatory bail. Accordingly, the same is rejected.
