JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

The prosecution case is that aunt of the informant, Asha Devi, has illicit relationship with co-accused, Chandradeo Prasad, which was protested by his father. There was an altercation between Asha Devi and father of the informant when father of the informant was assaulted, as disclosed by the villagers to the informant. Thereafter, the dead body of the father of the informant was recovered from an abandoned place. The petitioner was not named in the FIR, subsequently, his name sprang up after one and half month of registration of the case to the effect that the

Patna High Court Cr.Misc. No.54477 of 2015 (2) dt.02-12-2015 2/2 petitioner and co-accused Sonu Kumar caught hold the father of the informant when others made assault.

It is submitted by learned counsel for the petitioner that petitioner is unmarried girl and she is pursuing her studies at Patna. The FIR named accused persons Amit Kumar @ Sonu @ Sony Kumar @ Rakesh Kumar @ Amit @ sonu Kumar and Chandradeo Prasad have been granted anticipatory bail vide Criminal Miscellaneous No.46495 and 47374 of 2015. Considering the delayed accusation levelled against the petitioner merely on suspicion and there is no eye witness to the occurrence and petitioner being unmarried girl, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Hilsa, Nalanda in connection with Hilsa P.S. Case No.451 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
