The petitioner apprehends his arrest in connection with Mehsi P.S. Case No. 05 of 2023 registered for the offence under Sections 326, 307, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

The husband of the informant is alleged to have been killed by inflicting gun shot injury by the unknown person.

Considering the offence of murder by inflicting gun shot injury and the confessional statement of the co-accused,

Patna High Court CR. MISC. No.44706 of 2023(3) dt.11-10-2023 2/2 Pankaj Kumar, who happens to be son of the victim, recorded at paragraph-28 of the case diary, in which he has disclosed that the petitioner has arranged shooter for killing of the victim in lieu of Rs. 2,00000/- and out of which Rs. 50,000/- has been given to the petitioner in advance by him, this Court is of the opinion that prima facie case is made out against the petitioner and, therefore, this is not a fit case for grant of privilege of anticipatory bail to the petitioner even though he has not been named in the F.I.R. Accordingly, the prayer for grant of anticipatory bail to the petitioner is, hereby, rejected.
