JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-12-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420 and 120B of the Indian Penal Code.
It is alleged that complainant gave Rs.
1,56,000/- to co-accused Ali Akber for transfer of land when neither sale deed was executed nor money was returned. It is submitted by learned counsel for the petitioner that thrust of accusation is against Ali Akber and there is no proof with regard to the payment. There is counter version of the occurrence also.
Considering the nature of accusation, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount
Patna High Court Cr.Misc. No.56311 of 2015 (2) dt.11-12-2015 2/2 each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Complaint Case No. 05 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
