The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 349.2 litres of liquor was recovered from the vehicle in question and the petitioner was taken into custody.

It is submitted by learned counsel for the petitioner that no incriminating article was recovered from his possession. He has no concern with the seized liquor, the vehicle from which it was allegedly seized or with the driver of the said vehicle who escaped. The petitioner was arrested under a misunderstanding and has been falsely implicated in the case because of his antecedent. The petitioner is in custody since

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over 7 months, the petitioner is directed to be enlarged on bail in connection with Mohammadpur P.S. Case no. 159 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II - cum - Special Judge, Excise Act, Gopalganj.
