Petitioner seeks bail in Mahila P.S. Case No.21 of 2018 instituted for the offence under Section(s) 376 Indian Penal Code and Sections 4, 8, and 12 of the POCSO Act. Counsel for the petitioner submits that victim has gone with the petitioner on her own free will which will be apparent from the written report as well as from her letter enclosed as Annexure-2.

In the written report, it is alleged that informant got friendship with the petitioner through mobile. They were friends for last seven months. She went to the house of this petitioner on his call and stayed in the night. Petitioner established physical relationship with her.

Petitioner is in custody since 12.10.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Spl. Judge, POCSO Act, cum 1st Additional Sessions Judge, Munger, in connection with Mahila P.S. Case No.21 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner. (Sanjay Priya, J) J. Alam/- U T
