JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 06-07-2023 The present appeal has been filed to renew the prayer for grant of bail to the appellant which were earlier rejected vide orders dated 07.11.2017, 16.01.2019 and 15.07.2020 passed in Cr. Appeal (SJ) Nos. 2758 of 2017, 4537 of 2018 and 612 of 2020 respectively.
The allegation against the appellant is of firing on the husband of the informant, causing his death. It is submitted by learned counsel for the appellant that appellant is in custody since 26.07.2017 and up-till now the trial has not been concluded. In pursuance to the direction of this Court, a
Patna High Court CR. APP (SJ) No.3858 of 2021(9) dt.06-07-2023 2/2 report with regard to the present stage of the trial has been received which has been kept at Flag-Z. The report of learned Special Judge, SC/ST Act, Nawada dated 05.04.2023 suggests that out of sixteen prosecution witnesses, twelve prosecution witnesses have already been examined and the trial is likely to be concluded within six months.
Considering the fact that there is specific accusation against the appellant to have shot fire at the husband of the informant resulting into his death, this Court is not inclined to take a different view in the matter. The prayer for grant of bail to the appellant stands rejected.
The Trial Court is directed to expedite the trial and conclude the same within time as mentioned in its report dated 05.04.2023.
