====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 12-07-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 307, 302 and 120(B) of the Indian Penal Code and Section Section 27 of the Arms Act. This is the second attempt of the petitioner to seek bail as earlier his bail application was rejected by order dated 04.01.2023 in Cr. Misc. No. 53993 of 2022.

Learned counsel for the petitioner submits that petitioner is in custody since 03.02.2021. Learned counsel further submits that earlier when the bail application of the petitioner was rejected by order dated 04.01.2023 in Cr. Misc. No. 53993 of 2022 the date of custody was recorded as 27.09.2021 when it ought to have been 03.02.2021.

No.44213 of 2023(2) dt.12-07-2023 2/2 Considering the fact that petitioner is alleged to be one of the assailants of the deceased and informant being an eyewitness of the occurrence, the Court is not inclined to release the petitioner on bail in connection with Chousa P.S. Case No. 237 of 2020 pending in the Court of learned Additional Sessions Judge-VI, Madhepura/successor Court.
