The petitioner no.1 being brother-in-law of the informant and petitioner no.2 being wife of petitioner no.1 are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504, 448, 379/34 of the Indian Penal Code.
The prosecution case is that petitioners entered into the house of the informant and started abusing on protest being made they made assault to her. As a result, the informant got unconscious when she gain senses she found herself in a Primary Health Centre. It is alleged that accused persons took away jewellary and cash of Rs.5000/- kept in a box. It is submitted by learned counsel for the petitioners
Patna High Court Cr.Misc. No.54923 of 2015 (2) dt.04-12-2015 2/2 that due to family dispute the accusation has been levelled and the injury report reflects swelling and pain on foot, chest and whole body pain, which is found to be simple in nature. Considering the nature of accusation, nature of injury and nature of relationship between the petitioner and the informant, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Nawada in connection with Sirdala P.S. Case No.127 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
