JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-12-2018 The petitioner seeks regular bail in connection with Muffasil P.S. Case No. 87 of 2013, registered for offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.
Petitioner happens to be the husband of the deceased and allegation against him is of causing death of the deceased. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case only because he happens to be the husband of the deceased. Further submission is that in fact, the deceased committed suicide by hanging herself. It has also been submitted that petitioner has no criminal antecedent and has been in judicial custody since 08.08.2018.
Patna High Court Cr.Misc. No.66833 of 2018(3) dt.17-12-2018 2/2 Learned counsel for the State opposed the prayer for bail and submitted that petitioner is the husband of the deceased and the death has occurred within the forewall of the petitioner and further the petitioner disposed of the dead body of the deceased without informing the informant and his family members.
Having heard both sides, considering the facts and circumstances of the case and the nature of accusation, I am not inclined enlarge the petitioner on bail.
This application is accordingly dismissed.
The Trial Court is directed to expedite the trial and conclude the same as soon as possible.
