2. This civil miscellaneous application has been filed on behalf of the petitioner with a prayer for direction to the learned court below to expeditious disposal of Matrimonial Case No. 1044/2016 pending before the Principal Judge, Family Court, Patna.

3. Vide order dated 1.3.2024, the learned court below was directed to conclude the trial within a period of three months. In the same order it was also directed that the defendant should be provided an opportunity of three dates to conclude her evidence.

4. Meanwhile, the opposite party appeared through Video Conferencing and submitted that the interim maintenance

Patna High Court MJC No.1804 of 2023(8) dt.01-05-2024 2/2 awarded by the courts are not regularly being paid to her.

5. The learned counsel for the appellant submits that whatever dues are remained to be paid, shall be paid within a period of fifteen days.

6. The opposite party also submits that she has filed an application under Section 340 of CrPC which is still pending before the learned Principal Judge Family Court and it should also be decided expeditiously.

7. Learned Principal Judge Family Court, Patna shall ensure that the remaining dues of ad interim maintenance be paid to the opposite party within the assured period by the petitioner and the learned Principal Judge Family Court shall also make endeavour to dispose of the application under Section 340 of the CrPC as expeditiously as possible. The learned court below shall also ensure the compliance of order dated 01.03.2024 passed by this Court.

8. With these observations, this application is disposed of.
