JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date : 17-09-2018 Learned counsel for the petitioner submits that his client has taken no objection and he has no instruction to assist the Court in the present proceeding.

This writ application was filed in 2013 for quashing the order dated 01.11.2013 whereby petitioner was asked to hand over the charge of the school to Smt. Aruna Kumari, a teacher and to submit compliance report.

Petitioner was earlier working as Incharge Headmaster but on account of irregularity committed in distribution of midday-meal, scholarship, uniform and other benefits under the different schemes for the students, petitioner was removed from the post of Incahrge Headmaster and a direction was issued to

Patna High Court CWJC No.24381 of 2013 dt.17-09-2018 2/2 hand over the charge of the school to Smt. Aruna Kumari. There is no regular post of Incharge Headmaster in the school. The respondent authorities adopt the scheme of appointing individual as Incharge Headmaster for day-to-day activity of the school in absence of regular Headmaster.

Under the aforesaid circumstances, the Court is of the view that in the matter of appointment of Incahrge Headmaster and removal of the petitioner on account of irregularity committed in relation to distribution of mid-day-meal, scholarship, uniform and other benefits under different schemes for the students, does not warrant any interference. The writ application stands dismissed.
