The present writ petition has been preferred by the petitioner seeking initiation of departmental proceeding against the Respondent No. 5, Police Officer, who is Officer In-charge of Rajiv Nagar Police Station, Patna, as he has refused to lodge FIR on the written report of the petitioner. The petitioner is also seeking direction to the Respondent No. 5 to lodge FIR against

Patna High Court CR. WJC No.1078 of 2021(5) dt.02-09-2025 2/2 the Private Respondent Nos. 6 and 7.

3. Apparently, the present petition is misconceived.

4. If the Respondent No. 5 has not lodged FIR, the petitioner is at liberty to move before the Judicial Magistrate for lodging criminal complaint, which step has not been taken by the petitioner.

5. Accordingly, the present petition is dismissed as not maintainable.

6. The petitioner is directed to take legal remedy as indicated above.
