Both petitions arise out of the same case i.e. P.S Begusarai Town Case No. 505 of 2018 and accordingly, they. are being heard and disposed off by this common order. The petitioners seek bail in Begusarai Town Case
Patna High Court Cr.Misc. No.71471 of 2018(2) dt.10-12-2018 2/2 No. 505 of 2018 instituted for the offence under Section(s) 414 of the Indian Penal Code.
In the written report, it is alleged that both the petitioners had gone to the jewellery shop to sell the stolen gold ornaments when the police arrested the petitioners with alleged stolen ornaments.
Learned counsel for petitioners submits that, in fact, the alleged ornaments are not the stolen ornaments and it belongs to the mother of the petitioners. In support of said submission learned counsel for the petitioner(s) has filed photo copy of cash memo of the said ornament being purchased by his father which is annexed as Annexure-2 to the bail petition. Considering the aforesaid, let the petitioners of both cases, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the C.J.M., Begusarai, in connection with Begusarai Town Case No. 505 of 2018, subject to the condition that both the bailors shall be the close relative of the petitioners.
