The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code.

As per the prosecution case, while the informant was returning from his relatives place four accused persons robbed him of his motorcycle, mobile phone etc.

It is submitted by learned counsel for the petitioner that the FIR was registered against four unknown. The name of the petitioner transpired in course of investigation when allegedly the stolen mobile phone was recovered from the possession of the petitioner as also on the basis of the confessional statement of the petitioner make before police. It

Patna High Court CR. MISC. No.53267 of 2021(4) dt.19-04-2022 2/2 is submitted that contrary to the allegation no incriminating article has been recovered from the petitioner's possession who is in custody since 17.5.2021 and chargesheet has been submitted in the case.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for 11 months and chargesheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Bajpatti P.S. Case no. 100 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Pupri, Sitamarhi.
