The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 341, 323, 324, 307, 447, 504 of the Indian Penal Code. The prosecution case is that four accused persons including the petitioners came on a motorcycle at the house of the informant and started abusing him. On protest being made, petitioner no.1, Lallu Patel, assaulted on the left hand of the informant with 'dabiya' when informant's cousin nephew, Rajendra Kumar, came to rescue then petitioner no.2, Basu Patel, assaulted on his right hand with 'dabiya'. On alarm being raised when informant's wife, Sunaina Devi, came to rescue then she

Patna High Court Cr.Misc. No.54943 of 2015 (2) dt.04-12-2015 2/2 was also assaulted by all the accused persons. It is submitted by learned counsel for the petitioners that wife of the informant has not received any injury. Though, statement to that effect has not been made in the petition and the injuries of the informant and his cousin nephew have been found to be simple in nature. There is counter version of the occurrence also wherein the petitioners' sides have also received injuries. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Bettiah, West Champaran in connection with Bettiah Town (Kalibag) P.S. Case No.619 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
