====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 07-07-2021 Heard Mr. Harish Kumar, the learned Advocate for the petitioners and Harendra Prasad, the learned APP for the State.

The petitioners seek bail in anticipation of their arrest in connection with Garkha P. S. Case No.316 of 2020, instituted for the offences under Sections 406, 420, 323, 384, 379, 448, 427, 504, 506, 34 of the Indian Penal Code.

The accusation against the petitioners and his associates is of having forcibly entered the house of the informant and of taking away various valuables. The learned Advocate for the petitioners has submitted that he is the nephew of the informant and has been

Patna High Court CR. MISC. No.1255 of 2021(2) dt.07-07-2021 2/2 made accused in this case because of property dispute. All the other petitioners are related to petitioner no.1. There is nothing specifically alleged against any one of the petitioners. From the perusal of the F.I.R. itself, it would appear that because the petitioner no.1 was to inherit some property in his maternal grandmother's house, that this case has been lodged.

Regard being had to the background facts and the nature of accusation against the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Chandrabose Kumar, learned Judicial Magistrate, 1st Class, Chapra, Saran in connection with Garkha P. S. Case No.316 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
