JUSTICE ARUN KUMAR ORAL ORDER 20-12-2017 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Sahiyara PS Case No. 96 of 2017 registered under Section 392 of the IPC. The allegation in brief is that motorcycle of the informant was robbed on the way by three unknown miscreants, thereafter they escaped away taking away the motorcycle and after five days the looted motorcycle has been recovered from the house of the petitioner. Learned Counsel for the petitioner submits that at best a case under Section 414 IPC is made out. The petitioner was not put on TIP and is in custody for the last six months.
Co-accused from whose possession looted mobile has been recovered has been granted bail. Having considered the said facts and circumstances and the recovery of the looted motorcycle from the petitioner as well as large number of criminal antecedents of similar nature, the prayer of bail is rejected.
