Petitioners seek pre-arrest bail in Buxar (Industrial) P.S.Case No.153 of 2018 registered under Section 30(a) of the Bihar Prohibition and Excise Act.
Accusation is that one Bolero vehicle was searched from which total 522 litres Indian made liquor kept in cartoon was recovered. At that time Insurance paper and driving license were also recovered from the dickey of the vehicle which was in the name of Md. Abdul Kalam.
Submission on behalf of the learned counsel for the petitioners is that the petitioners are not named in the F.I.R. Later on Abdul Kalam who happens to be the owner of
Patna High Court CR. MISC. No.65061 of 2018(3) dt.22-04-2019 2/2 the vehicle from which the alleged Indian made liquor was recovered, disclosed the name of the petitioners and both the petitioners were also present near the vehicle for taking delivery of the seized liquor. Further submission is that the petitioners have no criminal antecedent.
Having heard both sides and in view of the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the learned court below within six weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Addl.Sessions JudgeIInd- cum-Special Judge, Excise, Buxar, in Buxar (Industrial) P.S.Case No.153 of 2018 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
