The petitioner is languishing in custody for the offence under Section 7 of the Essential Commodities Act. 370 bags of rice was recovered from a truck. The driver disclosed that the petitioner and others are involved in the black marketing the rice.
Submission is that rice is not a control item and only on the basis of label put on the bags of the rice it cannot be said that the same was of the Food Corporation of India because rice bags of Food Corporation of India are sold in the market. Petitioner has stated on oath that he has got no criminal antecedent.
Considering the aforesaid fact, let the petitioner,
Patna High Court CR. MISC. No.43202 of 2019(2) dt.12-07-2019 2/2 above named, be released on bail, on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Murliganj P.S. Case No. 132 of 2019, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court below having immovable property in his name.
(b) The petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) khushbu/- U T
