For the Petitioner/s : Mr. Sanjay Kumar Singh For the Opposite Party/s Mr. Ashok Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 05.12.2016 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.
Petitioner seeks anticipatory bail in a case registered under sections 272, 273 of the Indian Penal Code and section 47(a) of the Excise Act but the first information report goes to show that illegal Indian made foreign liquors were recovered from his shop and therefore, I am not inclined to extend the privilege of anticipatory bail to the petitioner. Hence, his prayer for anticipatory bail in connection with Kumarkhand P.S. Case no. 63/2016 pending in the court of the Chief Judicial Magistrate, Madehpura stands rejected. However, this order shall not cause any prejudice to the competent court while considering regular bail application of the petitioner, if the petitioner surrenders within six weeks from the date of receipt of this order to the concerned court and seeks regular bail. shahid (Hemant Kumar Srivastava,J) U T
