The petitioner is in judicial custody in connection with Khanpur P.S. Case No. 135 of 2021 under section 366/34 of the Indian Penal Code.

As per written complaint, it was alleged that the informant's sister has been kidnapped by amongst other the petitioner herein who demanded Rs. 10,000/- for her release. As per counsel for the petitioner, the victim girl in her statement under Section 164 of the Code of Criminal Procedure has not attributed any allegation so far as this petitioner is concerned. No.53934 of 2021(3) dt.19-04-2022 2/3 affidavit, he has brought on record the certificate of Sadhana Devi Vidyapith to show he is a student of class-X and is in jail since 26.6.2021 as stated in para-11 of the bail application. Considering the fact that he is a student aged about 21 years, is in jail since 26.6.2021 and charge-sheet has already been submitted, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial MagistrateIV, Samastipur, in connection with Khanpur P.S. Case No. 135 of 2021subject to following conditions:- (i) the learned Trial Court shall satisfy itself with regard to criminal antecedent of the petitioner while releasing him on bail;

(ii) one of the bailors should be the family members of the petitioner and will produce official document to show his bona fide;

(iii) the petitioner shall ensure his presence in the pending trial every month and failure to do so for two consecutive dates without plausible reason, the Trial Court shall cancel his bail bond;

(iv) the petitioner shall desist from committing any
