JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 10-11-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Pupri P.S. Case No. 121 of 2017 registered under Section 379 of the Indian Penal Code. As per the prosecution case, the motorcycle of the informant is said to have been stolen from the Pancheshwar Nath Mahadeo Temple, Pupri by some unknown miscreants. It is submitted by learned counsel for the petitioner that regarding the alleged recovery of the motorcycle from the possession of the petitioner another case, namely, Nanpur P.S. Case No.125 of 2017 has been instituted against him in which he has been enlarged on bail by this Court in Cr. Misc. No.43917 of 2017 vide order dated 22.09.2017. Petitioner is not named in the F.I.R. He has been languishing in custody since 10.05.2017.

No.53927 of 2017 (02) dt.10-11-2017 2/ 2 Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Pupri, Sitamarhi in connection with Pupri P.S. Case No.121 of 2017.
