JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 05-04-2016 Writ petition was filed by the Association for providing adequate space for the Association so that the lawyers may function efficiently. The said space is to be provided in the new up-coming building of the Industrial Tribunal and other connected office.

A supplementary counter affidavit has been filed on behalf of the respondents. Mr. P.K. Verma, A.A.G.-5 draws attention of the Court to the averments made in paragraph 4 thereof which is reproduced hereinbelow:- "4. That it is submitted that sufficient space has been earmarked and provided for the Advocates practicing in the Labour Court, Patna, as well as in the Industrial Tribunal, Patna on the sixth floor of the newly constructed building i.e. Niyojan Bhawan. The Labour Court Patna, and the Industrial Tribunal, Patna have been provided office space separately. An area of

Patna High Court CWJC No.4971 of 2013 (6) dt.05-04-2016 2/2 31 ft. x 15ft. has been provided for the Advocates beside the Labour Court, Patna similarly an area of 31 ft. x 15ft has been provided for the Advocates beside the Industrial Tribunal, Patna respectively in Wing-B and Wing-C on the sixth floor of the Niyojan Bhawan. The said space will be finally allotted to them after it is furnished."

Considering the facts of the case, in my view, the grievance of the petitioner has been redressed by the respondents and the application does not merit further persuasion. If any difficulty is faced by the petitioner Association, it may approach the concerned respondent for removal of the difficulty which shall be examined by the appropriate/competent authority in accordance with law. The writ application is disposed of.
