JUSTICE MADHURESH PRASAD ORAL ORDER 19-12-2017 Heard learned counsel for the petitioner and learned APP for the State.

This is a case registered under Sections 188, 147, 148, 149, 323, 324, 341, 342, 337, 427, 307, 353, 452, 379, 153(A), 504, 506 and 120(B) of the Indian Penal Code. It is submitted that a general and omnibus allegation regarding raising slogan and resorting to brick bat by a mob of about 500 persons during idol emersion of goddess Durga, has been made. The petitioner is one among the 44 named accused persons. There is no specific allegation against the petitioner and only suspicion has been raised against him and he is in custody since 17.10.2017. On the basis of such allegations he has been implicated in one another case which has been mentioned in Para 3 of the petition. Prior to this occurrence, there is no criminal antecedent of the petitioner. Other similarly situated co-accused

Patna High Court Cr.Misc. No.60173 of 2017 (2) dt.19-12-2017 2/2 has been allowed anticipatory bail in Cr. Misc. No. 57394 of 2017. Petitioner is in jail custody since 17.10.2017. In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad in Arwal P.S. Case No. 199 of 2017 subject to the conditions : (i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.

(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
