2. The petitioner seeks bail in connection with Makhdumpur P.S. Case No. 77 of 2025 registered for the offence punishable under Sections 20 and 22 of the N.D.P.S. Act.
3. As per the prosecution case, 71.08 kg of green plant of ganja has been recovered from the agricultural field of the petitioner.
4. It has been submitted by learned counsel for the petitioner that it is the son of the petitioner and not the petitioner who is involved in such illegal activity.
5. The petitioner is in custody since 03.05.2025.
6. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.41773 of 2025(5) dt.17-09-2025 2/2 son of the petitioner has surrendered in the Court below on 12.09.2025.
7. Considering the aforesaid fact, this application is allowed.
8. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Principal District and Sessions Judge, Jehanabad in connection with Makhdumpur P.S. Case No. 77 of 2025.
9. At the time of accepting bail bonds of the petitioner, the Court below will verify the fact that whether the son of the petitioner has surrendered in the Court below or not. If it is found that the son of the petitioner has surrendered in the Court below, the bail bonds shall be accepted and if not appropriate order shall be passed by the Court below.
