JUSTICE SUDHIR SINGH ORAL ORDER 24-02-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 341, 323, 324, 307 and 34 of the Indian Penal Code.

Allegation against the petitioners is that due to a petty dispute they assaulted and stabbed two associates, namely, Akash and Golu of informant and also pushed him (informant), as a result he fell down and received scratches on his elbows. It is submitted on behalf of the petitioners that they have got no criminal antecedent. No specific injury has been attributed against them. Petitioners have falsely been implicated due to village politics.

On behalf of the State, it is submitted that petitioners are named in the F.I.R. and there is specific allegation against Suman Saurav.

Considering the aforesaid facts and circumstances, let the

Patna High Court Cr.Misc. No.55795 of 2015 (3) dt.24-02-2016 2/2 above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Town P.S. Case no. 547 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
