JUSTICE VINOD KUMAR SINHA ORAL JUDGMENT Date : 08-03-2019 The appellants seek pre arrest bail in connection with Patori P.S. Case No. 85 of 2018, registered for offences punishable under Sections 406, 420, 323, 504, 506 of the Indian Penal Code and Section 3 (i)(r)(s)(x) of SC/ST Act.

Allegation against the appellants is that they collected the money from the informant and others for depositing the same in Sahara Indian and Properties India presenting themselves to be agent of the said companies with a promise that the money will be doubled on maturity but when the informant and others demanded their money back, appellants said to have abused the informant by caste name.

It has been submitted on behalf of the appellants that they

Patna High Court CR. APP (SJ) No.3987 of 2018 dt.08-03-2019 2/2 have falsely been roped in the present case and they are not the agents of the Sahara Indian and Properties India and further there is no allegation that the appellants have taken the money. Heard learned Special P.P. also.

Having heard both sides, considering the facts and circumstances of the case and the nature of accusation, I am not inclined to grant the privilege of pre-arrest bail to the appellants rather they should surrender before the court below and pray for regular bail, which will be disposed of by the concerned court below on the merit of the case, without being prejudiced by the order of this Court.
