JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-01-2018 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Siwan Muffasil P.S. Case No. 348 of 2017 for the offences punishable under Sections 272, 273, 308, 420 of the Indian Penal Code, and section 41(1) of Bihar Prohibition Excise Act, 2016. Allegation is that when the police had reached at the house of the petitioner, at that time the petitioner was standing at the door of his house, but after seeing the police he fled away after throwing carry bag and when the bag was searched 3.600 liter of illicit foreign liquor was recovered.

The learned counsel for the petitioner submits that the petitioner is innocent, no illicit liquor has been seized from the

Patna High Court Cr.Misc. No.60038 of 2017 (3) dt.17-01-2018 2/2 person of the petitioner, he was also not apprehended on the spot and the entire allegation is concocted. The petitioner is stated to be in custody since 28.8.2017.

Considering the nature of allegation and the period of custody already undergone, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge cum Special Judge, Siwan in connection with Siwan Muffasil P.S. Case No. 348 of 2017.
