The petitioner seeks regular bail in Chowk P.S. Case No. 95/2016, instituted for the offences punishable under Sections 399, 402 and 412 of the Indian Penal Code and section 5(1-b)a, 26 and 35 of the Arms Act.
Learned counsel for the petitioner has submitted that petitioner is not named in the F.I.R. He was not apprehended on the spot. There is no recovery from his possession. Name of the petitioner has been disclosed by the co-accused Praveen Kumar Mishra, Rahul and Dipak Kumar in their confessional statement. Other accused persons have already been granted bail by different benches of this court vide order dated 15.09.2016 passed in Cr. Misc. 31501/2016, dated 23.09.2016 passed in Cr.
Patna High Court Cr.Misc. No.68014 of 2018(3) dt.27-11-2018 2/2 Misc. 37961/2016, dated 23.12.2016 passed in Cr. Misc. 55466/2016 and dated 16.12.2016 passed in Cr. Misc. 53463/2016.
Considering the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate II, Patna in connection with Chowk P.S.
