Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 307, 379, 506/34 and 302 of the Indian Penal Code.

Allegation of commission of injury at the head of the husband of the informant is against Anil Yadav as a result whereof husband of the informant died. Allegation of commission of assault to other injureds is against other persons. The petitioner is alleged to have assaulted the mother-in-law of the informant. The Doctor has found simple injury on the person of mother-inlaw. Learned counsel for the informant opposed the prayer for bail on the ground that three prosecution witnesses have

No.59378 of 2017 (3) dt.05-02-2018 2/2 been examined in this case and they have consistently deposed that the petitioner caught the husband of the informant first and thereafter Anil Yadav assaulted causing injury at the head. Considering the subsequent development during course of trial as well as the fact that the petitioner is a female, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No. 633 of 2017 arising out of Telhara Police Station Case No. 97 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
